Attorney-Client Relationship
An attorney-client relationship is established only after you have signed a formal engagement agreement with Prothots and any required retainer fees have been paid. Simply browsing our website, submitting a contact form, or participating in an initial consultation does not automatically create an attorney-client relationship.
Our free initial consultation is designed to evaluate your case and determine if Prothots is the right fit for your legal needs. During this consultation, we will discuss your legal issue, potential strategies, and our fee structure. Information shared during the initial consultation is kept confidential, but formal representation begins only upon execution of a written agreement.
No Guarantee of Results
While Prothots is committed to providing exceptional legal representation and pursuing the best possible outcome for your case, we cannot guarantee specific results. Legal proceedings are inherently unpredictable and subject to numerous factors beyond our control, including court decisions, opposing counsel, witnesses, and applicable law.
Any case results, testimonials, or success stories shared on our website represent outcomes in specific cases and should not be construed as a guarantee or prediction of results in your matter. Each case is unique and must be evaluated on its own merits.

Fees, Payment Terms, and Billing
Legal Fee Structure
Prothots offers transparent and competitive pricing for our legal services. Our fee structure varies depending on the type and complexity of your case, and may include:
- Hourly Rates: For certain matters, we bill on an hourly basis based on the time spent by our attorneys and staff working on your case
- Flat Fees: For routine legal matters, we offer fixed-price services that provide cost certainty
- Contingency Fees: For personal injury and certain other cases, we work on a contingency basis, meaning we only collect fees if we win your case
- Retainer Agreements: Some cases require an upfront retainer deposit, which is held in a trust account and applied against future legal fees
All fee arrangements will be clearly outlined in your written engagement agreement before we begin work on your case. We provide detailed invoices and maintain transparent communication about all costs associated with your representation.
Payment Methods and Terms
Prothots accepts various payment methods including credit cards, debit cards, bank transfers, and certified checks. Payment terms will be specified in your engagement agreement and typically require payment within 30 days of invoice date unless otherwise agreed.
Failure to pay fees when due may result in suspension of legal services and could impact our ability to represent you effectively. We reserve the right to withdraw from representation if payment obligations are not met, subject to applicable ethical rules and court approval where required.
Costs and Expenses
In addition to legal fees, you are responsible for reimbursing reasonable costs and expenses incurred in connection with your case, including but not limited to court filing fees, expert witness fees, deposition costs, travel expenses, copying charges, and legal research expenses.
Confidentiality and Attorney-Client Privilege
Protection of Client Information
Prothots is committed to protecting the confidentiality of all client information in accordance with professional ethical obligations and applicable law. All communications between you and our attorneys are protected by attorney-client privilege, which prevents us from disclosing your confidential information without your consent.
This privilege extends to all forms of communication, including in-person meetings, telephone calls, emails, video consultations, and documents shared through our secure client portal. We implement robust security measures to safeguard your information from unauthorized access or disclosure.
Limitations on Confidentiality
While we maintain strict confidentiality standards, there are limited circumstances where disclosure may be required or permitted:
- When required by law, court order, or legal process
- To prevent death or substantial bodily harm to any person
- To establish a claim or defense in a controversy between you and Prothots
- To comply with professional ethics rules or legal obligations
- When you provide written consent for disclosure
In all cases, we will make reasonable efforts to notify you before making any disclosure unless prohibited by law or court order.

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you to Prothots for legal services during the six months preceding the claim.

Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these terms or your use of our services shall be brought exclusively in the state or federal courts located in New York County, New York.
By using our services, you consent to the personal jurisdiction of these courts and waive any objection to venue in these courts based on inconvenient forum or any other basis.
Dispute Resolution Process
In the event of any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or our services, you agree to first attempt to resolve the dispute informally by contacting Prothots directly. We will work in good faith to resolve any concerns through direct communication.
If we are unable to resolve the dispute within 30 days, either party may pursue formal legal remedies. However, before filing any lawsuit, you agree to participate in mediation if requested by Prothots, with costs shared equally between the parties.
Modifications to Terms and Conditions
Prothots reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. When we make changes, we will post the updated terms on our website and indicate the date of the most recent revision.
Your continued use of our website and services following the posting of revised terms constitutes your acceptance of the changes. We encourage you to review these Terms and Conditions periodically to stay informed of any updates.
If you do not agree to the modified terms, you must discontinue use of our website and services immediately. Material changes that significantly affect your rights will be highlighted or communicated directly when possible.
Termination of Services
Termination by Client
You have the right to terminate our legal services at any time by providing written notice to Prothots. Upon termination, you remain responsible for payment of all legal fees and costs incurred up to the date of termination, as well as any reasonable costs associated with concluding representation and transferring your file.

- You fail to cooperate or communicate with us regarding your case
- A conflict of interest arises that prevents continued representation
- You engage in conduct that violates these Terms and Conditions
- Continued representation would violate ethical rules or legal obligations
In cases requiring court approval for withdrawal, we will seek such approval before terminating representation. Upon termination, we will take reasonable steps to protect your interests, including providing notice and opportunity to obtain substitute counsel.

Your privacy is important to Prothots. We collect, use, and protect your personal information in accordance with our Privacy Policy, which is incorporated into these Terms and Conditions by reference. Severability and Waiver
Severability of Provisions
