Immigration Law FAQs

Answers to common questions about immigration processes, requirements, and timelines.

How long does it take to get a green card?
Green card processing times vary dramatically based on the category and your country of origin. Immediate relative petitions for spouses, parents, and unmarried children under 21 of U.S. citizens typically take 12-24 months. Family preference categories can take 2-20+ years depending on priority date and country. Employment-based green cards range from 6 months to several years depending on category and country. We provide realistic timelines specific to your situation and work to expedite processing whenever possible.
Can I work while my green card is pending?
If you're adjusting status from within the U.S., you can apply for an Employment Authorization Document (EAD) along with your green card application. The EAD typically arrives within 3-6 months and allows you to work for any employer while your green card is pending. If you entered on a work visa like H-1B, you can continue working for your sponsoring employer. We help ensure you maintain work authorization throughout the green card process.
What are the requirements for U.S. citizenship?
To apply for naturalization, you must be a permanent resident for at least 5 years (3 years if married to a U.S. citizen), be at least 18 years old, demonstrate continuous residence and physical presence in the U.S., have good moral character, pass English and civics tests, and take an oath of allegiance. Certain exceptions apply for elderly applicants, those with disabilities, or military service members. We assess your eligibility and help you prepare thoroughly for the citizenship process.
How hard is it to get an H-1B visa?
H-1B visas are competitive due to the annual cap of 85,000 (65,000 regular cap plus 20,000 advanced degree exemption). Employers must first register during the lottery period, and only selected registrations can file full petitions. The selection rate varies yearly but has been around 40-50% in recent years. Once selected, the petition must demonstrate the position requires a bachelor's degree, the beneficiary has qualifying education/experience, and the employer will pay the prevailing wage. Cap-exempt H-1Bs are available for certain employers like universities and nonprofits.
What happens if I overstay my visa?
Overstaying your visa has serious consequences. If you overstay by more than 180 days but less than one year, you face a 3-year bar from returning to the U.S. If you overstay for one year or more, you face a 10-year bar. However, immediate relatives of U.S. citizens may still be able to adjust status within the U.S. despite overstaying. Some overstays can be forgiven through waivers for extreme hardship. If you've overstayed or are approaching your departure date, contact us immediately to explore your options before accruing unlawful presence.
Can I apply for asylum if I entered illegally?
Yes, you can apply for asylum regardless of how you entered the United States. Asylum law specifically protects the right to seek asylum even if you entered without inspection or documents. However, you must generally apply within one year of your last arrival in the U.S., though exceptions exist for changed circumstances or extraordinary circumstances. Illegal entry alone does not disqualify you from asylum, but it may affect other immigration options if asylum is denied. The critical factor is whether you have a well-founded fear of persecution based on protected grounds.
How can I bring my family to the U.S.?
The pathway depends on your immigration status. U.S. citizens can sponsor spouses, children, parents, and siblings through family-based immigration, with immediate relatives (spouses, unmarried children under 21, parents) having no visa wait times. Permanent residents can sponsor spouses and unmarried children, though with longer wait times. Many temporary visa holders can bring dependents (H-4 for H-1B, L-2 for L-1, F-2 for F-1, etc.). The process involves filing I-130 petitions, proving the family relationship, and meeting financial sponsorship requirements. We help reunite families through the most appropriate and efficient pathway.
What should I do if I'm in removal proceedings?
If you receive a Notice to Appear (NTA) or are placed in removal proceedings, contact an immigration attorney immediately. Time is critical - you may have relief options such as cancellation of removal, asylum, adjustment of status, or other forms of relief. Never miss a court hearing, as this results in an automatic removal order. Don't sign any documents from ICE without speaking to an attorney. We provide aggressive defense in immigration court, exploring every possible avenue to fight your removal and keep you in the United States with your family.
